Viwone deeply cares about protecting your Personal Data by implementing a continuous process to improve its compliance with Applicable Regulation to ensure the highest level of protection for your Data.

The Privacy Policy governs the Personal Data of all Users collected and processed when the Website is used and when Products and Services offered on the Website or in store are ordered and used.

This Privacy Policy is an integral part of Viwone’s General Terms and Conditions of Sale and may be amended by Viwone at any time, in particular in order to comply with legal, regulatory, editorial or technical evolutions.

Viwone will ensure that you are informed of any amendment to this Privacy Policy either by means of a specific mention on our Website or by means of a personalized warning.

For the purposes of this privacy policy, capitalized terms – whether singular or plural – shall have the following meaning:

  • Application shall mean the Viwone Pure app available on Google Play and the Apple App Store and compatible with some of our Products.
  • General Terms and Conditions of Sale shall mean Viwone’s general terms and conditions of sale available here.
  • Cookies shall mean the trackers and/or equivalent technologies, i.e., cookies, “Flash” cookies, fingerprinting, local web storage, invisible pixels, used alternatively or cumulatively to (i) facilitate the User’s browsing, (ii) offer products and services suited to the User’s interests, (iii) allow for the compilation of statistics and (iv) allow the User to access customized Products and Services on the Website or via messages sent by Viwone and enable interaction with social networks.
  • Personal Data or Data shall mean any information relating to a natural person who is directly or indirectly identified or identifiable in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. Thus, the data we collect may include strictly personal data in that they identify you as a specific person. Conversely, certain data do not identify you directly, such as your job or your browsing data (type of browser, terminal and operating system, path followed on the Website, etc.) but are nonetheless considered Personal Data because they are linked or can be linked to data of the first category.

  • Website shall mean the www.viwone.com website.
  • Users shall mean all the members, subscribers and users of the Website and of the Products and Services.

The controller is the company that defines how and for what purpose your personal data are used.

Personal data collected on the Website, the Application, the Products and Services or when you purchase items in stores are processed by VIWONE SAS, a French simplified joint stock company with a share capital of twenty thousand (20,000) Euros, having its registered office 48 Boulevard Gouvion-Saint-Cyr PARIS 75017 – FRANCE, registered with the Paris Trade Registry under number 818 318 123, Phone n°: (+33) 01.47.49.36.81, European VAT n° FR0581831812300010.

The Data are in particular stored with the Website’s hosting company identified in the legal notices as well as with Avempace, the company in charge of Viwone’s after-sales services and application management.

This Privacy Policy applies to the Data we collect and use when:

  • you purchase or use the Products and Services on the Website or in the shop;
  • you browse the Website;
  • you exchange with Viwone services in the context of requests for assistance, complaints or when you fill out a form on the Website;
  • you submit comments concerning the Products and Services;
  • or you participate to a Viwone a study, survey or competition;
  • you connect to the Application by entering your contact details to identify yourself and authenticate your Product.

The Data may be provided directly by the User or automatically collected by Viwone.

4.1. Data transferred directly by the User

When you order Products or use Services, you directly provide Viwone with Data concerning yourself. Some Data are necessary for the provision of the Products and Services: if you do not provide these Data or if you ask us to erase them, you may no longer be able to access or use our Products and Services. An asterisk indicates Data that are mandatory.

These Data include in particular:

  • Data necessary to order, invoice and deliver your orders for Products and Services, such as your name, address, phone number, e-mail address, delivery address, the number, security code and expiry date of your credit or debit card used to pay for your order, data concerning your purchases and other transactions with Viwone. Viwone does not access your credit or debit card information which is stored with the payment service providers of Viwone that you use. If you request that your order be delivered to another person (as a present for example), we use the Data you provide concerning the other person to deliver the order.
  • Data necessary for the creation and customization of your Client or User account: some of our Products and Services allow or require you to create a Client or User account in order to log in to the Products and Services. This username also allows Viwone to consolidate the Data collected across a range of Products and Services to offer you the best experience. The data you may provide are your first name, surname, postal address, phone number, date of birth, login ID, password, pseudonym, e-mail address, age, gender, login credentials from third party services (Facebook, Google+), favourite content, Client or User account settings (privacy, notification and sharing preferences) and Data related to the terminal or devises you use and chose to provide to us.
  • Data concerning your exchanges with our customer service and after-sales service,, such as the Data you submit to us by e-mail or via forms, Data enabling our services to identify you, the date, time and reason for your request, the content of your exchanges with the service and the additional Data necessary to process your request.
  • Data you provide to us when you choose to participate to a Viwone study, survey or competition.
  • Data you provide when you send us comments concerning the Products and Services you use.
  • Data you provide to us when you exercise the rights mentioned in article 10 of the Policy.

4.2. Data we automatically collect

When you use our Products and Services, Viwone automatically collects certain Data concerning your connection to the Website and your browsing, your use of our Products and Services, the interactions with proposed advertisements.

These Data include in particular:

  • Data collected when you use and browse the Website such as the IP address, the types of browsers, the language of your browser, the operating system, State or country from which you access the Website, Products and Services, the characteristics of your software and hardware equipment (including device identifiers), referring and exit pages, URL, platform type, number of clicks, files you download, domain names, home pages, pages viewed and order of these pages, time spent on certain pages, search terms you use on our Website, date and time you used the Services and downloaded or published content, error logs, and other similar data.
  • Data collected when you use the Products and Services: when you use your Product or Service, we may automatically receive data about how you use the Product:
    • Technical data, such as the product’s serial number and model, device operating system version, MAC address(es), Wi-Fi® signal strength, firmware version, IP address, SSIDs, log files, duration, type of internet connection and operator, as well as the unique identifiers associated with the device used with the Product;
    • Usage data, such as the time spent using different features/settings of the Product, the date and time you used the Product, sensor data, media and other external sources to which you connect your Product and, where applicable, the power, sound pressure level of your Product and the content streamed (including content stored on system pre-sets, stations played, playlists, artists, albums, songs or podcasts), the time zone and transactions data enabling to manage digital rights (for example, so that music content providers can pay artists based on how often their songs are played);
    • Authentication tokens, containing authentication information enabling to integrate third-party content to the Product (for example, to synchronize your Products to your terminal each time you use them or to a music streaming application);
    • Diagnosis data, such as battery autonomy, wireless connection quality and error logs; and
    • Environmental data (ex.: sound level and audio frequencies).
  • Data collected when you use the Viwone Services and in particular the Viwone Pure application:
    • Connection and browsing data such as IDs or identifiers of devices used to access the Services such as the characteristics of the devices and software used to connect to the Services, data concerning the connection to Services, such as the type of Internet connection and the operator, statistics on the pages of the Services displayed, the activity or inactivity rate;
    • Data relating to your interaction with the Services and in particular favourite contents (artists, albums, songs, radios, podcasts), any updates for your Application and your Products, the date and time the Services and Application were used, the way you use the Services and Application, in particular the time spent in the different parts of the application, content viewed or downloaded (including listening history, playlists created (public or private) or followed, artists, albums, songs or podcasts);
    • Data relating to interaction with other users of the Services such as comments on an artist page or album page, the users whose activity the User decides to follow or who decide to follow the User’s activity (subject to the User’s privacy settings);
    • Data related to potential malfunctions and incidents encountered when using the Application, which will allow us to make the necessary corrections and improve your user experience.
  • Geolocation Data: when you use our Website or our Products and Services, we and our Partners may automatically collect data enabling us to locate you such as your IP address, city/State and/or post code associated to an IP address from your computer or your mobile device. Such data allow us, for example, to offer you a radio station based on your location or to make it easier for you to enter your delivery address when placing an Order.
    We ask for your authorization before collecting GPS location data. If you no longer wish to allow us and our service providers to collect and use GPS location data, you may disable these features on your Product or terminal. If you disable these features, you will no longer be able to access or benefit from all or part of the Services, content, features and/or products made available via the Services. As a matter of example, using Bluetooth on Android requires the activation of the location service in order to connect your Product with your other devices.
  • Data collected on social networks, third-party platforms and applications: If you access the Products and Services through a third-party log in or identification (for example a social network), you may allow us to access and store certain Data from your social network profile, such as your name, your gender, you profile picture, “likes” and follows, as well as the list of your friends, depending on your settings on these social networks. If you do not wish these Data to be shared, you should not log in through a social network to access our Website, Products and Services. When you click “Like” or when you follow us on social networks, we may collect certain Data concerning you such as your name, e-mail address as well as the comments or content you publish and that is relevant to us. We also collect your Data if you sign up for one of our promotions or submit data to us through social networks websites.
    To obtain a description of the way the social networks websites process your Personal Data, you should review their privacy policy and their terms of use to modify your privacy settings.
  • Data collected from other sources: Viwone may receive Data from third parties, such as business partners, marketing agencies, researchers, analysts and other third parties, which we may link to you based on your assignment to certain statistical groups. We use these Data to enrich the ones we collect directly from you to determine what you are interested in, offer you more relevant experiences with Viwone and improve the Products and Services, Viwone’s analytics and advertising.

Viwone may collect, store and process the above-mentioned Data for the following purposes:

  • To carry out the purchase of a Product or the subscription to a Service or to the Application, to manage invoicing operations, payment, accounting and delivery, and follow-up on the order;
  • To provide, improve and customize the Products and Services according to the User’s preferences resulting from his/her use of the Services, the information communicated, the interactions with the Products and Services and his/her browsing to enable Viwone to better understand the needs and interests of the User;
  • To provide sharing tools on social media networks and platforms when the User has agreed to the sharing of information;
    To ensure the security of the Website, Products and Services;
  • To carry out analyses, research and draft reports concerning connection and browsing on the Website, to measure traffic on the Website, elaborate commercial and marketing statistics;
  • To manage the relationship with the User, the after-sales service, the complains, to respond to any request for information from the User and to enable the User to exercise his rights set out in article 10 of the Policy, to understand and solve incidents and other problems reported by the User concerning our Products and Services;
  • To provide the User with information and updates on the Products and Services;
  • To manage User’s comments on the Website and/or pages published by Viwone or hosted on websites or social networks;
  • To contact the User by e-mail, text messages, post or telephone to carry out satisfaction surveys, studies, promotions, competitions and other events likely to be of interest to the Users or to send the User, by means of newsletters, information on the Products and Services as well as advertisements and commercial offers;
  • To customize advertisements, promotional offers and Services content, to inform the User of offers and news from Viwone and its Partners, to enable Viwone and its partners to send the User newsletters, offers, information, products alerts;
  • To fight against fraud and non-payment;
  • To comply with all laws, regulations, and procedures applicable to Viwone when necessary to serve the legitimate interests of Viwone and others;
  • To establish, exercise and defend Viwone’s rights when necessary to serve the legitimate interests of Viwone and others.

The legal basis for collecting, storing, using and transferring your Data are as follows:

  • Performance of Contract: when the processing of the Data is necessary to perform the contract you have entered into with Viwone;
  • Consent: when you agree to the processing of your Data in accordance with Applicable Regulation, by means of a click or checkbox;
  • Legitimate interest: when the use of your Data is necessary to satisfy a legitimate interest of Viwone or other party, such as a commercial or security interest that is just, balanced and does not infringe your privacy. Save for some exceptions, you may object to a processing based on legitimate interest at any time by notifying Viwone in accordance with the terms of article 10 of the Policy;
  • Legal requirement: when the processing of your Data is necessary to comply with our legal obligations.

In accordance with Applicable Regulation, Viwone undertakes not to keep Users’ Data for a period exceeding what is strictly necessary for the purposes pursued.

Viwone undertakes to archive, anonymise, and erase Data as soon as the purpose or storing period expires.

Maximum retention periods apply unless a request for erasure or cessation of processing is made before these periods expire (in accordance with the rights set forth under article 10 of the Policy). However, upon expiry of these periods, the Data may be subject to intermediate archiving for us to meet our legal, accounting and tax obligations.

The Data collected or processed by Viwone when connecting to or browsing the Website or when purchasing or using our Products and Services are intended for Viwone, for authorized persons within Viwone who, for the purpose of their duties, need to be aware of such Data for the purposes of processing and, in certain cases, for the following persons:

  • Viwone’s service providers. To ensure the proper provision of the Products and Services, Viwone may provide access to your Data or share them with certain third-party service providers who perform one or more services on our behalf. These service providers are not allowed to use your Data for other purposes. This includes providers of the following services: payment and invoicing, sale, marketing, products content and features, advertisement, analytics, studies, customer service, delivery, Data processing and storage, security, fraud prevention, legal services.
  • Business partners. We can share some of your Data with business partners, but only with your consent.
  • Social networks if the User has expressly agreed to associate its Client or User account with his/her social networks accounts when registering on the Website or by setting up his/her Client or User account for this purpose.
  • Third party platforms and applications accessible from Viwone Products and Services: when the User connects through the Products and Services to a third-party platform or application, he/she acknowledges and agrees that the terms and conditions of the third-party service will apply to these connections (and not Viwone’s). The User should therefore read these third-party’s privacy and security policies.
  • Public forums when the User publicly shares comments with other Users, through the features of the Products and Services. The Data communicated through these features are in no way considered confidential.
  • Administrative or judicial authorities: Viwone may have to communicate information concerning its Users, including the Data, to administrative or judicial authorities in particular pursuant to orders.

Data may be transferred to service providers, subcontractors, Partners located outside the European Union. Before such transfer, and in accordance with applicable regulation, Viwone implements the procedures required to obtain the necessary guarantees concerning the security of such transfers, in countries that do not offer an appropriate level of protection, for example by means of contractual clauses.

Some of your Data will be transferred to Avempace, a company whose registered office is located in Tunisia, in charge of after-sales service and application management on behalf of Viwone.

In accordance with Applicable Regulation, Viwone makes every effort to process your Data in a secure and confidential manner.

In particular, Viwone implements the technical and organizational measures necessary to guarantee the security and confidentiality of Data collected and processed, in particular to prevent them from being distorted, damaged or communicated to unauthorized third-parties, by ensuring a level of security appropriate to the risks associated with the processing and the nature of the Data to be protected, taking into account the level of technology and implementation costs.

However, Viwone may not guarantee the confidentiality of Data made public by the User.

The Products and Services may include links to websites or external sources. The User acknowledges that the Policy applies only to connection to and browsing on the Website and to the use of the Products and Services, but that it does not apply to Data collected and/or processed on external websites or sources which may be linked to the Website or to the Products and Services. Consequently, Viwone shall not be liable for the practices of such external websites or sources with respect to the collection and processing of your Personal Data, which are governed, where applicable, by the privacy policies of each of these external websites or sources.

Pursuant to articles 14 to 22 of Regulation 2016/679 dated April 27th, 2016, any User has the following rights:

  • A right to access pursuant to which you may access your Data;
  • A right to rectification pursuant to which you may update and rectify your Data if they are obsolete or inaccurate;
  • A right to object to the collection and processing of Data pursuant to which you may prevent the processing of your Data for certain purposes or object to the way Viwone processes certain Data;
  • A right to erasure pursuant to which you may erase your Data;
  • A right to restrict collection and processing pursuant to which you may restrict the processing of some of your Data;
  • A right to data portability pursuant to which you may transfer your Data to a third-party service provider.

The User also has the right to communicate instructions concerning the storage, erasure and communication of his/her Data after his/her death.

Viwone shall examine all the Users’ requests concerning the exercise of their rights and shall send them a reply within 1 month of the request being sent. This period may exceptionally be extended to 2 months if the request is complex. The User acknowledges that Viwone may refuse to comply with a User’s request concerning the exercise of his/her right, in particular if the Data must be processed to serve the legitimate interests of Viwone or a third-party or to comply with a legal obligation. The User is informed that the exercise of certain of his/her rights, in particular the rights to object and to erasure, may restrict or prevent his/her access and/or use of the Products and Services.

Viwone reserves the right to verify the identify of the User before complying with his/her request.

In the absence of any reply or if the User is not satisfied with the reply provided, the User may lodge a complaint with the competent supervisory authority within the EU member state where he/she usually resides. The Products and Services are not intended for minors. Accordingly, Viwone does not process Data specifically relating to minors. Parents and any other person exercising parental authority shall decide whether the minor is allowed to use Viwone Products and Services.

13.1. What is a cookie?

A cookie is a connection indicator such as a beacon, tag, invisible pixel or any other system making it possible to access, collect and/or store, in a dedicated space of the User terminal (computer, tablet, etc.), information regarding the User’s browsing and/or his/her activity in respect of advertisements displayed on the Services.

From a technical and functional standpoint, there are four types of cookies:
